Subscription or Project Terms

How CAQA Analytics engagement plans, analytics projects and retainers are scoped, invoiced, varied and cancelled.

These Subscription or Project Terms apply to analytics engagements arranged through CAQA Analytics, part of CAQA Groups and operated by Career Calling International Pty Ltd (ABN 53 162 651 238). Client work is performed under an agreed proposal, quote, service agreement, retainer or written scope. The scope will identify the deliverables, assumptions, client responsibilities, fees, payment terms, timelines and review process. Clients are responsible for providing accurate, complete and timely information. Work outside the agreed scope may require a variation, additional fee or revised timeline.

1. Engagement plans

CAQA Analytics offers three engagement models, described on our pricing page: the Monthly Engagement Plan, an ongoing subscription-style retainer covering regular data health checks, analytics reporting and continuous business and system analysis; the Quarterly Project Plan, for medium-term projects such as market analysis, tailored data-analysis projects and system upgrade planning; and the Customised Solutions Plan, for bespoke analytics, business analysis and system redesign work. Whichever plan applies, every engagement begins with a scoped proposal stating deliverables, hours and milestones before any work starts.

2. Proposals and acceptance

A proposal or quote remains open for the period stated on it. An engagement commences when the client accepts the proposal in writing or pays the first invoice, whichever occurs first. The proposal, these terms and any service agreement together form the engagement contract; if they conflict, the signed proposal or service agreement prevails.

3. Fees, invoicing and payments

No payments are taken through this website - there is no online checkout or payment gateway. Fees are invoiced under the accepted proposal: monthly engagements are typically invoiced in advance each month, project plans are typically invoiced against milestones, and customised solutions follow the schedule stated in the proposal. Invoices are payable by the due date and method shown on the invoice. GST is applied where required, and work may be paused if invoices remain unpaid after reasonable notice.

4. Cancellation and refunds

Monthly Engagement Plans may be cancelled with written notice as set out in the proposal; unless otherwise agreed, cancellation takes effect at the end of the current billing month and the current month's services are delivered in full. Project and customised engagements may be cancelled in writing at any time; the client pays for work performed and third-party costs committed up to the cancellation date, and any prepaid amounts covering work not yet performed are refunded. If CAQA Analytics cannot deliver agreed work, we will offer a remedy, replacement or refund of amounts paid for the undelivered work. Nothing in these terms limits the consumer guarantees, rights or remedies that apply under the Australian Consumer Law.

5. Client responsibilities

Clients agree to supply the datasets, system access, documentation and subject-matter input identified in the proposal within the agreed timeframes; to ensure data is provided lawfully as described in our Data Processing and Security Notice; to nominate a contact person authorised to give feedback and approvals; and to review deliverables promptly. Delays in supplying inputs may extend timelines or require a variation.

6. Deliverables, review cycles and acceptance

Each proposal states the deliverables - such as dashboards, reports, models, cleaned datasets or documented pipelines - and the number of review rounds included. Feedback consolidated within the agreed review window is incorporated; substantial changes of direction, new data sources or additional dashboards beyond the scope are handled as variations. Deliverables are taken to be accepted when the client confirms acceptance or when the review window passes without a change request.

7. Intellectual property

On payment in full, the client receives the rights in the deliverables stated in the proposal - usually a licence or assignment covering internal business use of the dashboards, reports and outputs produced for them. CAQA Analytics retains ownership of its pre-existing methods, templates, code libraries and know-how, and the client retains ownership of the data it supplies.

8. Confidentiality

Each party must keep the other's confidential information secure and use it only for the engagement. Client data, commercial information and results are not disclosed to unrelated third parties, and are used in marketing or case studies only in aggregated or de-identified form unless the client consents in writing.

9. Limits of service

Analytics outputs support decision-making but do not replace it. Responsibility for operational, financial, regulatory and governance decisions made using our deliverables remains with the client, as explained in our Dashboard Disclaimer.

10. Contact

Questions about these terms, an existing engagement or an invoice can be directed to info@caqa.com.au, by phone on 1800 266 160, or through our contact page.
